SMT JUSTICE T. RAJANI CRIMINAL PETITION No.11882 of 2011 ORDER:

This Criminal Petition under Section 482 Cr.P.C., is filed by the petitioner/respondent No.3 seeking to quash the proceedings against him in D.V.C.No.1 of 2011 on the file of Judicial Magistrate of First Class, Proddatur, for the offences alleged under the Domestic Violence Act, 2002.

Heard learned counsel for the petitioner and learned counsel for the 2nd respondent.

Learned counsel for the petitioner submits that there is no domestic relationship between the petitioner and the 2nd respondent; that the 2nd respondent is a stranger to the petitioner; that the petitioner has no role to play in the family affairs of the 2nd respondent and her in-laws and that the said act of the petitioner does not by itself attract the offences under the Domestic Violence Act.

When there is no domestic relationship between the 2nd respondent and petitioner, the proceedings in D.V.C against the petitioner cannot be permitted to proceed with. 5.

Accordingly, the Criminal Petition is allowed quashing the proceedings against the petitioner/respondent No.3 in D.V.C.No.1 of 2011 on the file of Judicial Magistrate of First Class, Proddatur. Miscellaneous petition, if any, pending in this petition shall stand closed.
