ORDER

This writ petition is filed challenging inaction of the respondents on the complaint dated 10.12.2014 lodged by the petitioner in respect of suspicious death of her husband viz., Chinna Bala Hussain.

Learned Government Pleader for Home, on written instructions, submits that Cr.No.17 of 2017 was registered on 4.2.2017.

Though the writ petition was filed in the year 2015, the crime was registered on 4.2.2017 and therefore, this Court on 14.2.2017 pointed out as to why the delay has occurred in registering the crime.

In pursuance of the said order, a counter-affidavit is filed by the 2nd respondent stating that on receipt of the representation from the petitioner on 10.12.2014, the same was forwarded to the 3rd respondent for necessary action. The 3rd respondent endorsed the same to the 4th respondent, who made enquiries and it came to light that funeral of the deceased took place on 09.12.2014 and in those circumstances, there was no possibility to send the dead body of the deceased for forensic analysis. On noticing that the allegations made in the representation of the petitioner are false, the 4th respondent did not register any crime. Thereafter, the petitioner did not approach the 2nd respondent. However, based on

the fresh complaint of the petitioner dated 4.2.2017, Cr.No.17 of 2017 was registered. It is further stated that on noticing irregularities on the part of the then Station House Officer and the then Inspector of Police, it was decided to initiate disciplinary action against them and accordingly, charge memo was issued to them on 7.3.2017.

In view of registration of crime, the Writ Petition is closed. However, the 2nd respondent is directed to pursue further course of action pursuant to the charge memo dated 7.3.2017. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
