HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No. 8786 of 2013 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Mr.E.Manohar, learned Senior Counsel for the petitioner, submits that the order impugned in the instant writ petition has also been challenged by the petitioner in appeal (Annexure P3) before the appellate authority under Section 31 of the Air (Prevention & Control of Pollution) Act, 1981 and Section 28 of Water (Prevention & Control of Pollution) Act, 1974 and the petitioner would be satisfied if directions are issued to the appellate authority to decide the appeal within timeframe.

It appears that since the Presiding Officer of the appellate authority was not available, the petitioner had filed the instant writ petition and this Court vide order, dated 15.05.2013, granted interim order in favour of the petitioner.

It is not in dispute that the Presiding Officer of the appellate authority is now available and the appeal filed by the petitioner can be heard and decided on merits. In view thereof, learned counsel for the parties have agreed for disposal of the writ petition with the following order:

"The appellate authority shall consider and decide the appeal, as aforementioned, filed by the petitioner against the order impugned

in the present writ petition, as expeditiously as possible and preferably within a period of six months from today. The petitioner is directed to place this order before the appellate authority within a period of two weeks from today.

Interim order passed by this Court, dated 15.05.2013, shall remain operative pending the hearing and final disposal of the appeal. All contentions of the parties are kept open." With these observations, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, also stand disposed of.
