ORDER:- Heard learned counsel for the petitioner and learned government pleader for Revenue.
2. The impugned notice No.J/5660/2015 dated 26.09.2015 is questioned, wherein eviction of the petitioner is contemplated alleging that he has encroached in FTL Area. Petitioner however claims that the lands are patta lands and they have a valid title and lay out in their favour.
3. This writ petition is similar to the one considered by this court in W.P.No.30844 of 2015 dated 23.09.2015.
4. Following the said writ petition, this writ petition is also allowed. Operative portion of the said order is as follows:- "Hence, the writ petition is allowed and the impugned notice is set aside. The competent authority shall, however, be at liberty to follow due process of law, if any action is intended to be taken against the petitioners." As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
