HONOURABLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.10409 OF 2015 ORDER:

Heard.

The grievance of the petitioner is that no crime is being registered on his complaints, dated 05.03.2015 and 30.03.2015 addressed to the 2nd respondent. Learned Government Pleader for Home, on instructions, submits that the complaint of the petitioner was forwarded by the 2nd respondent to the Deputy Superintendent of Police, Kakinada on 10.03.2015. After due examination of the same, it was found that the petitioner himself is an accused in Crime No.37 of 2015 and 139 of 2014 which are pending before the II-Town (Land & Order) Police Station, Kakinada.

It is also stated that the allegations made in the complaint are against police officers, who are attending their duties. It is stated that this Court while disposing of WP No.25760 of 2014 and batch filed by Pilli Thrimurthula Satyanarayana and others, who is a close associate of the petitioner herein, through common order dated 24.03.2015 directed the II-Town (Law & Order) Police, Kakinada to complete the investigation in the respective cases in accordance with law. The petitioner herein is one of the accused in Crime Nos.37 of 2015 and 139 of 2014, and this Court has already issued directions to the respondent police to complete the investigation in accordance with law in WP No.25760 of 2014 and batch, referred to above. In view of the above instructions, the grievance of the petitioner for registration of another crime cannot be considered. Since the investigation, as per the orders of this Court referred to above, is already pending, no directions

as sought for by the petitioner are warranted under the facts and circumstances of the case.

Hence, the Writ Petition is dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. ______________________ VILAS V. AFZULPURKAR, J April 28, 2015.
