THE HON'BLE SMT. JUSTICE G. ANUPAMA CHAKRAVARTHY SECOND APPEAL No.1044 of 2000 JUDGMENT:

On 13.06.2022, it was reported by the learned counsel for the appellant that the sole appellant had died and they have to bring his LRs on record. Therefore, the matter was directed to be listed on 20.06.2022.

2. Inspite of specific direction, the matter was not listed on 20.06.2022 and it was listed on 18.11.2022. On the said day, there was no representation for the appellant. Again, when the matter was listed on 02.12.2022, as there was no representation for the appellant in the forenoon or in the afternoon, it was directed to be listed under the caption 'for dismissal' on 05.12.2022.

3. Though the matter is coming up under the caption 'for dismissal', today also there is no representation for the appellant either in the forenoon or in the afternoon.

4. Therefore, the second appeal is dismissed for default and for non-prosecution. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
