HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2783 of 2015 ORDER:

The petitioner was appointed as Office Attender on 24.12.1990. Thereafter, he was promoted as Unit Helper on 07.04.1998 and his services were regularized. While so, the 3rd respondent issued proceedings dated 21.11.2011 confirming the services of Education Multi Media Research Centre (EMRC) staff, wherein the name of the petitioner was also shown. The UGC-VI Pay Commission Scales were also implemented by proceedings dated 13.09.2010. While so, the Government of India issued Office Memorandum dated 29.08.2008 granting Transport Allowances for the Central Government Employees as per the recommendations made by the Sixth Pay Commission. When the same was not paid to the petitioner, the present writ petition was filed.

A counter-affidavit was filed by the 3rd respondent stating that the petitioner submitted representations on 16.11.2014 and 18.12.2014 for grant of Transport Allowances as per Office Memoranda dated 29.08.2008 and 31.08.2008 issued by the Government of India. It was also noticed that the petitioner is eligible for payment of Transport Allowance of Rs.1600/- + D.A. thereon. It is stated in the counter-affidavit that the University is under the process of issuing necessary orders as per the said Memoranda.

3. In view of the above, this Writ Petition is disposed of directing the respondents to pay the Transport Allowances to the petitioner as admitted in the counter-affidavit, within a period

of three months from the date of receipt of a copy of this order. No order as to costs.

Miscellaneous petitions, if any, pending shall stand closed.
