THE HONOURABLE SRI JUSTICE RAJA ELANGO CIVIL REVISION PETITION No.2828 OF 2017 ORDER:

This Petition under Article 227 of Constitution of India is filed challenging the order of the Principal Junior Civil Judge, Ramachandrapuram, East Godavari District in I.A.No.585 of 2014 in O.S.No.513 of 2004.

The only grievance of the petitioner is that the trial Court without considering the objections raised by the petitioner herein and others, passed the impugned docket order.

The impugned docket order reads as under:

"The objections memo filed by the 4th respondent is rejected. For casting and lots call on 28.12.16."

As rightly pointed out by the learned counsel for the petitioner, the trial Court has not assigned any reasons in the impugned order for rejecting the objections filed by the petitioner and others. Hence, the impugned order is hereby set aside and the matter is remanded to the trial Court to consider the objections raised by the petitioner and others and pass the orders afresh in accordance with law. Accordingly, the Civil Revision Petition is disposed of. No costs.
