THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 40064 of 2014 ORDER:

This Writ Petition is filed for the following relief: "...to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus by declaring the inaction of the respondents Nos.2 to 4 who is not taking any investigation on FIR No.396 of 2014 by securing/care about the children and consequently direct the official respondents to trace out the petitioner's children by name Mohd.Abdul Quavi, 9 years; daughter Mybhin, 7 years and younger son Mohd. Omar Farooq, 6 years while arresting the culprits in above said crime." Learned Assistant Government Pleader for Home has stated that in view of order passed by this Court on 20.02.2015 in Crl.P.No.889 of 2015 staying all further proceedings in Crime No.396 of 2014 on the file of Saidabad Police Station, respondent police are not proceeding with the investigation and that the Sub-Inspector of Police, Saidabad Police Station, had filed a petition for vacating the said interim order of stay and the same is pending.

In those circumstances, this Writ Petition is closed leaving it open to the respondent police to workout their remedies in Crl.P.No.889 of 2015.

Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
