THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5543 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.60 of 2016 on the file of CCS, Hyderabad, registered for the offence punishable under Sections 406, 420 and 506 r/w 34 IPC. Heard and perused the material available on record. It is alleged that the petitioners approached the 2nd respondent on 15.9.2005 representing that they had memorandum of understanding with one Max Worth Orchids Limited to purchase 150 acres at Kandukur village in different survey numbers and the petitioners are authorized to sell the said property. Believing the same, the 2nd respondent entered into agreement of sale with the petitioners to purchase the said land and paid the amount to the petitioners.

Thereafter, the petitioner evaded the registration of the land on some pretext or the other and the accused deceived the 2nd respondent by promising to repay the money paid by him. Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by the petitioners. However, the 1st respondentpolice are directed to complete the investigation and file a final report, if any, without arresting the petitioners. In the event of necessity, the 1st respondent-police are directed to issue notice to the petitioners to appear before the investigating agency for the purpose of investigation.
