THE HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.19983 of 2019 ORDER:
This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the 2nd respondent in seizing the petitioner's vehicle Lorry bearing No.KA 52 A 5387 by the 2nd respondent in connection with Crime No.106 of 2019, as illegal, arbitrary and against the principles of natural justice and sought a consequential direction to direct the 2nd respondent to release the petitioner's vehicle.

Learned Government Pleader for Home basing on the written instructions, dated 16.09.2019, submits that during course of investigation in Crime No.106 of 2019 of Dammapeta Police Station, dated 05.07.2019, registered for the offence under Section 304-A IPC, one lorry bearing No.KA 52 A 5387 was seized on 13.09.2019 by the Investigating Officer and on the same day itself the said lorry was deposited before the Judicial Magistrate of First Class, Sattupalli. 3.
Since the lorry has already been deposited before the concerned Court and as the petitioner has efficacious alternate remedy under Section 451 Cr.P.C., no relief can be granted in this writ petition. 4.
Accordingly, this writ petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed. No costs.
