THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY C.R.P.No.3907 of 2012 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India challenging the order dated 11.07.2012 in I.A.No.452 of 2011 in O.S.No.565 of 2010 passed by the I Junior Civil Judge, Secunderabad in a petition filed under Order 1 Rule 10 of the Code of Civil Procedure to implead the petitioners themselves as defendants 4 to 6 in the suit.

According to the contention of the learned counsel for the respondent, the suit was dismissed after full-fledged trial before the trial Court. Therefore, the plaintiff in the suit preferred first appeal in A.S.No.73 of 2013 before the I Additional Chief Judge, Secunderabad and the same was allowed on 06.03.2015. The petitioner before the trial Court in implead petition also filed W.P.No.23935 of 2010, which was ended in dismissal by order dated 11.08.2014. Even according to the material collected from the ecourtindia the suit was disposed of on 01.05.2013. However, the appeal was allowed by the appellate Court passing decree in favour of the plaintiff in the suit. Therefore, in this revision petition nothing remains for adjudication by this Court and consequently, the revision petition is liable to be dismissed. In the result, the civil revision petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the criminal petition, shall stand closed.
