HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.36852 OF 2014 O R D E R :

This petition is filed seeking a Writ of Mandamus declaring the action of the respondents 2 to 4 in interfering with the possession and constructional activities of the petitioner inspite of the sanctioned building permission vide permit No.164/99 dated 23.09.1987 issued by the 2nd respondent and for a consequential direction to the respondents 2 to 4 not to interfere with constructional activities of the petitioner.

The case of the petitioner is that during the lifetime of her late husband, he obtained permission from the respondents 2 to 4 for construction of a residential house, but due to financial crisis, and also ill health of her husband, they could not make constructions in the subject property and the permission got lapsed. When the petitioner started construction, the respondent authorities tried to interfere with same, as such, the present writ petition is filed. It is also stated that after filing of the present writ petition, the petitioner made a fresh application to the authorities on 03.12.2014 for grant of permission.

Heard the learned counsel for the petitioner and Sri R.Radhakrishna Reddy, learned Standing Counsel for respondents 2 to 4.

Since, it is stated that the petitioner has made a fresh application for grant of building permission on 03.12.2014, the competent authority is directed to dispose of the same in accordance with law.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if

any, pending, shall stand closed.
