HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6019 of 2019 O R D E R :

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A.1 to A.6 seeking to quash the proceedings in Cr.No.188 of 2019 on the file of the Station House Officer, Khammam III Town Police Station, registered for the offences punishable under Sections 270,271 and 273 read with 34 Indian Penal Code( for short, 'IPC').

Heard the learned counsel for the petitners/A.1 to A.6, learned Additional Public Prosecutor representing the respondent-State and perused the material on record. Learned counsel for the petitioners/A.1 to A.6 would submit that in similar circumstances this Court vide common order, dt.27.08.2018, in Crl.P.No.3731 of 2018 and batch quashed the proceedings against the petitioners therein for the IPC offences punishable under Sections 270 and 273 IPC while permitting to proceed with for the offence punishable under Sections 20(2) of the Act. It is further submitted that in this case, the prosecution alleges only IPC offences against the petitioners and prays the above order may be applied in this case.

Learned Additional Public Prosecutor does not dispute the same.

Following the said order and for the reasons stated therein, this Criminal Petition is allowed quashing the proceedings in Cr.No.188 of 2019 on the file of the Station House Officer,

Khammam III Town Police Station, registered for the offences punishable under Sections 270, 271 and 273 read with 34 IPC. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
