HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.23906 of 2016 ORDER:
Vide present writ petition, the petitioners seek writ of Mandamus, declaring the action of the respondents in trying to acquire the land admeasuring Ac.1.21 guntas falling in Sy.No.642 of Dharmaram Village, Konaraopeta Mandal, Karimnagar District by mentioning wrong names of pattedars instead of the petitioners herein as reflected in the revenue records vide Notification Pro.No.G1/2127/2016 dated 07.05.2016 for the purpose of construction of Malakpet Reservoir, as illegal.
2. Heard both sides. At the time of arguments, learned counsel for the petitioners drawn to the attention of this court about the revenue record dated 23.05.2016 at page 16, wherein the names of the petitioners are indicated as pattadars in Sy.No.642, but in the Notification Pro.No.G1/2127/2016 dated 07.05.2016, the name of the pattadar is shown as Kommula Yellava W/o Yellaiah. The petitioners came to know that their names are not mentioned in the notification, they made representations/objections dated 23.05.2016, with relevant documents, to the respondents 3 and 4, but till date, no decision has been taken by them.

Keeping in view of the averments made in the said petition and also the submission of the learned counsel for the petitioners, I hereby direct the above mentioned respondents to decide the representation/ objections dated 23.05.2016 filed by the petitioners, within a period of four weeks from the date of receipt of a copy of this order, by giving opportunity of hearing to all the concerned. The decision taken thereon shall be conveyed to the petitioners within a period of one week thereafter. Till the decision is conveyed to the
petitioners, the respondents are directed not to disburse the compensation amount in favour of any one.
4. With the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition shall stand closed.
