THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.19953 of 2019 ORDER:

This writ petition is filed by the petitioners with a prayer to issue a writ of mandamus to declare the action of the respondent Nos.4 & 5 in proceeding for demolition of the respective houses and landed properties of the petitioner without following the due process of law and high handedly trying to occupy the properties of the petitioners and without initiating the land acquisition proceedings and without payment of compensation to the petitioners for the lands and buildings going to be acquired, as illegal and arbitrary and further direct the respondents not to proceed in further in this regard without following the due process of law.

2. Heard the learned counsel for the petitioners, learned Assistant Government Pleader for respondents 1 to 3 and the learned Standing Counsel for respondents 4 and 5.

3. The case of the petitioners is that they are all residents of Venkateshwarpally village, Narlapur Post, Kamalapur Mandal of Warangal Urban District and that the respondents are trying to demolish the houses of the petitioners for widening the existing 10 feet road to 22 feet, without following the due procedure.

4. Sri G. Narender Reddy, learned Standing Counsel appearing for respondent Nos.4 and 5 submits that as on today there is no demolition drive and that there is only proposal to widen the road. He

further submits that as and when any action is taken for widening the road, the respondents will follow the due procedure.

5. In view of the submission of the learned Standing Counsel, the writ petition is disposed of directing the respondents not to demolish the houses of the petitioners without following due process of law.
