THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14525 of 2010 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ of Mandamus to declare the action of respondent in not taking any steps on the representation made by the petitioner on 25-1-2010 in respect of a candidate belonging to the Schedule Caste Community is illegal, arbitrary and is in violation of the principles of natural justice."
When the matter is called, a letter bearing No.C2/2837/2010, dated 02-07-2010 addressed by the Collector and District Magistrate, Mahabubnagar, to the office of the learned Government Pleader for Social Welfare, High Court has been placed on record by the learned Government Pleader and the said letter reads as under:
"I invite kind attention to the reference 1st cited, and submit here with the particulars of the above W.P.No.14525/2010 filed by Sri Boyapally Narsimulu Madiga S/o.Venkataiah, Occ. District Spokes Person, Magida Porata Samithi, Mahaboobnagar District regarding to allegation on caste status of Sri S.B.Johnson S/o.Barnabas R/o.Amarachintha Village of Atkur Mandal as follows.
In this case earlier a complaint has been received to this office vide ref 2nd cited from the Secretary, AP State Commission for SCs & STs, Hyderabad stating that one Sri P.Surya Prakash, President of
A.P.Ambedkar Youvajana Sangham, Mahabubnagar. The petitioner in his petition has stated that during the year Sri S.B.Johnson, S/o.Barnabas R/o.Amarachintha village of Atmakur Mandal has been appointed as Forest Beat Officer under S.C. quota whereas his forefathers were already converted to Christianity while taking baptism at Amarachintha Church. Hence the petitioner has requested to take necessary action duly conducting enquiry. In this regard the same has forwarded to the Revenue Divisional Officer, Narayanpet vide ref 3rd cited with a direction to furnish the report on caste status of the above person.
The Revenue Divisional Officer, Narayanpet has submitted a report vide ref 4th cited, stating that Sri S.B.Johnson, S/o.Barnbas R/o.Amarachintha (V) of Atmakur Mandal belongs to "MADIGA" (SC) and the caste certificate issued is genuine one. Hence the same facts has already been submitted to the Secretary, AP State Commission for SCs & STs, Hyderabad vide reference 5th cited. A copy of the same along with Revenue Divisional Officer, Narayanpet and Tahsildar, Atmakur reports are enclosed herewith for kind perusal."
In view of the information furnished in the above said letter, nothing survives in the writ petition for adjudication. Accordingly, the writ petition is closed. There shall be no order as to costs.
