HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN WRIT APPEAL No.998 OF 2018 JUDGMENT (ORAL) : (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard Sri G. Vidyasagar, learned Senior Counsel appearing for the appellants, and Sri S. Niranjan Reddy, learned Senior Counsel appearing for the contesting respondents - writ petitioners. 2.

The Writ Appeal is against an interlocutory order issued in the course of the writ petition. The impugned order discloses fair application of mind by the learned single Judge on the facts of the case. It also discloses that the learned single Judge has considered, prima facie, the applicable laws including by making reference to a judgment of this Court. On the whole, we are satisfied that this appeal would not merit acceptance against the interlocutory order since the discretionary interlocutory order has been issued by stating reasons and considering such materials and legal issues which are levelled at that stage. 3.

Therefore, we do not find any ground to interfere with the writ appeal. However, we clarify that we have not spoken anything on the merits of the matter; it will be left for consideration by the learned single Judge in the writ petition.

Subject to the aforesaid, the Writ Appeal fails and the same is dismissed accordingly.
