HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.5437 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking the following relief: " ... to issue Wirt of Mandamus or any other appropriate writ or order or direction against respondent Nos.1 & 2 to put writ petitioner into physical possession of assigned agriculture land admeasuring Ac.5-05 Gts. forming part of Sy.No.693 of Lalgadi Malakpet Village, Shameerpet Mandal, Ranga Reddy by following statutory procedure as contemplated under provisions of AP Assigned Lands Act 1977 in seeking eviction of respondent Nos.4 & 5 from illegal possession and enjoyment by considering final representations made by writ petitioner, dated 11.01.2016 and pass such order or orders as this Hon'ble court deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents 1 to 3. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondents 4 and 5 on notice since this Court is not venturing to adjudicate the case on merits.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the representation of the petitioner made on 11.01.2016.

Learned AGP would submit that the 1st respondent may be directed to dispose of the representation of the petitioner, if the same is still pending consideration.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 1st respondent i.e. District Collector, Ranga Reddy District, to consider the application dated 11.01.2016 made by the petitioner, if the same is still pending consideration, and dispose of the same in accordance with law, after hearing the petitioner and other aggrieved party, if any, including respondents 4 and 5, as early as possible preferably within a period of three months from the date of receipt of a copy of this order.
