THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.16614 of 2008 ORDER:

The relief sought for in this writ petition is to declare the proposed action of the respondents in giving No Objection Certificate for quarrying mineral in Survey No.287 of Thimmapuram Village, Duttaluru Mandal, Nellore District as arbitrary and illegal.

My attention is drawn by Sri N.Narasimha Rao, learned counsel for the petitioners, to the averments in the counter affidavit to submit that the District Collector had rejected the six applications vide proceedings dated 30.08.2008, and no single application was considered for mining lease in Survey No.287 of Thimmapuram Village. Learned counsel for the petitioner would submit that, in view of the specific averment in the counter affidavit, the cause in the writ petition does not survive, and the writ petition has become infructuous.

The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
