THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11994 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue Writ of Mandamus declaring the action of the respondents in not including the name of the petitioner's institution to participate in counseling of DIETCET for the academic year 2014-15 though the inspection team of the 5th respondent conducted on 22-07-2013 and not passed the order inspite of the facts that the petitioner society/college fulfilled the NCTE norms and not permitting the petitioner institution to participate in spot admission of DECET on par with other colleges, is illegal, arbitrary, discriminatory and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to consider the case of the petitioner college for grant of permission/affiliation by taking into consideration of the spot inspection conducted on 22-07-2013 and the memo No.5394/Progh.II/A1/2015, dated 17-04-2015."

Heard Sri K. Satyanarayana Murthy, learned counsel for the petitioners and learned Government Pleader for School Education for respondents, apart from perusing the material available before this Court.

Today, when the matter is taken up, it is submitted by the learned counsel for the petitioners that for redressal of the grievance, the petitioners herein submitted representation, dated 17-12-2014 to the Regional Director, SRC NCTE, Banglore - 5th respondent herein. Learned counsel for the petitioners further requested this Court to direct the 5th respondent herein to take appropriate action on the said representation, dated 17-12-2014 by fixing some time frame.

On the other hand, it is the submission of the learned Standing Counsel for the National Council for Teacher Education that the committee was informed that the college is situated in some other premises.

Taking into consideration the totality of the circumstances and without going into the merits and demerits of the case, this Court deems it appropriate to dispose of the writ petition with a direction to the 5th respondent herein to pass appropriate orders on the representation of the petitioners dated 17-12-2014 by fixing some time frame.

For the aforesaid reasons, the writ petition is disposed of directing the 5th respondent herein to take appropriate action on the representation of the petitioners, dated 17-12-2014 and pass appropriate orders within a period of one month from the date of receipt of a copy of this order, in accordance with law and communicate the order to the petitioners herein. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
