HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.5534 of 2011 O R D E R:

The petitioner, a member of the Mandal Parishad Territorial Constituency, Dommarnandyala Mandal Praja Parishad-2, Mylavaram Mandal, YSR Kadapa District, filed this writ petition assailing the action of the police authorities in interfering with the personal liberty of himself and of his family and sought a consequential direction to provide him protection for casting his vote in the ensuing elections for the A.P. State Legislative Council, Kadapa Local Bodies Constituency. This election was held in the year 2011. By order dated 4.3.2011, this Court directed the police authorities not to interfere with the life and liberty of the petitioner. No counter affidavit has been filed till date.

As the grievance of the petitioner seems to have been in the context of the Legislative Council Election of the year 2011, it may not survive for consideration at this stage. Further, the police authorities can only interfere with the liberty of the petitioner and his family only if warranted and at that, in accordance with the due procedure laid down by law. The writ petition is accordingly closed making the aforestated position clear.

Pending miscellaneous petitions shall also stand closed. No order as to costs.
