THE HON'BLE SRI JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO W.A.No.112 OF 2015 JUDGMENT: (Per Hon'ble Sri Justice A. Ramalingeswara Rao) This Writ Appeal is directed against the order, dated 23.08.2013, in W.P.No.21981 of 2005, seeking a writ of mandamus declaring the action of the respondents in not releasing salaries attached to the posts held by the petitioners from October/November, 1995 to June, 1997, as illegal and arbitrary. The said Writ Petition was wrongly clubbed with W.P.Nos.4207 of 2005 and batch and was disposed of by the learned Single Judge on 23.08.2013. The subject matter in the said batch of Writ Petitions is different. Now it is agreed by both the learned counsel that the relief sought in W.P.No.21981 of 2005 does not relate to the said batch of Writ Petitions and it ought not to have clubbed with the said Writ Petitions and disposed of.
As the said relief is not related to the batch of Writ Petitions, the Government filed the present Writ Appeal. Now, it is clear that no separate order is passed in W.P.No.21981 of 2005. In that view of the matter, we deem it appropriate to hear the Writ Petition on merits by the learned single Judge. Hence, the Writ Appeal is disposed of remanding the matter to the learned Single Judge, who has provision to hear the Writ Petitions (Service Matters) and request him to dispose of the same as expeditiously as possible.
Consequently, W.A.M.P.No.4074 of 2014 is disposed of and no orders are necessary in W.A.M.P.No.74 of 2015. There shall be no order as to costs.
