THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3548 of 2011 ORDER:
This writ petition was filed alleging that the police authorities were not properly investigating Crime No.670 of 2009 on the file of the Saifabad Police Station.
Basing upon the written instructions dated 09.06.2015 furnished by the SubInspector of Police, Saifabad Police Station, Hyderabad, the learned Assistant Government Pleader for Home stated that upon the complaint made by the petitioner, Crime No.670 of 2009 was registered under Sections 448 and 380 I.P.C. on the file of the Saifabad Police Station. However, the petitioner was stated to have failed to cooperate with the investigation, and therefore, the case was closed for lack of evidence after obtaining the permission of the Assistant Commissioner of Police, Saifabad. The final report was also submitted under Section 173 Cr.P.C. before the learned Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, but the same was returned with a direction to obtain the signature of the petitioner/complainant. The Sub-Inspector however stated that he was unable to trace out the petitioner/complainant.
In the light of the above stated developments and given the decision arrived at by the police authorities, it is for the petitioner to avail appropriate remedies in accordance with law, if she wishes to pursue the matter further. Reserving liberty to the petitioner to do so, the writ petition is dismissed. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
