HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.20037 of 2019 ORDER:

The prayer of the petitioner in this Writ Petition is as under: "...to issue any appropriate writ order or direction particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents as arbitrary, illegal and violative of Articles 14 16 and 21 of the Constitution of India and consequently direct respondent Nos.2 and 3 in delaying the process of investigation in Crime No 03/2018 dated 12.01.2018 filed under Sec 420, 423, 465 R/w 34 IPC Sec 1563 Cr P C on the file of Respondent No.2 P S Nagaram dated 16.08.2017 on the ground that Respondent No.2 did not receive the clarification from Respondent No.3 as illegal arbitrary, violative and against the principles of natural justice and also against the Articles 14, 16 19 and 21 of Constitution of India and consequently direct Respondent Nos.

2 and 3 to complete the investigation and file the charge sheet within the stipulated time and to and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." Learned Assistant Government Pleader for Home produced the written instructions dated 13.9.

"It is submitted that during the course of investigation L.Ws.1 to 9 were examined and their statements were recorded served a notice u/s 91 Cr.P.C. to the complainant, alleged accused and collected the documents concerned from them further also collected documents from the revenue authorities.

It is submitted that in this case the investigating is almost completed, after obtaining superior officer permission, case will be finalised within a period of six weeks." Recording the aforesaid written instructions, the Writ Petition is disposed of directing the respondent Police to file an appropriate final report within a period of six weeks from the date of receipt of a copy of this order.

As a sequel, Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
