THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20465 of 2019 ORDER:

In this Writ Petition, petitioner asserts that he became the owner of plot No.2, admeasuring 100 sq.yards, and farm house plot No.10, admeasuring Ac.0.9 guntas, covered by Survey No.6, situated at Dargah Khaleej Khan Village, Rajendranagar Mandal, Ranga Reddy District, having purchased the same through registered sale deeds dated 15.12.2014 and that recently, he noticed that respondent Nos.4 and 5 are developing the land, which includes his plots also, as such, he lodged a complaint to the second respondent - Commissioner, Hyderabad Metropolitan Development Authority (HMDA), Hyderabad, asking that in what circumstances, permission came to be granted for development, when the property sold to him is included. His grievance is that in spite of such objection, no action is being taken by the respondent authorities.

Learned Standing Counsel for HMDA appearing for respondent Nos.2 and 3 produced before this Court the written instructions issued by the third respondent - Deputy Commissioner, HMDA, Hyderabad.

As per the aforesaid written instructions, the land covered by Survey No.6/P of Kismatpur-ORRGC Village, GandipetORRGC Mandal, Ranga Reddy District, over an extent of

CKR, J W.P.No.20465 of 2019 30728.74 sq.meters, is taken up for development by M/s.Keerthi Estates Private Limited, represented by its Managing Director, K. Anil Kumar Reddy, and the said Anil Kumar Reddy had placed various documents before the authorities of HMDA and after going through the same, draft layout approval was released on 03.04.2019. Thereafter, the objections of the petitioner were received on 16.07.2019 i.e., three months after granting permission in favour of the said Keerthi Estate Private Limited to development. However, objections of the petitioner would be considered and necessary action would be taken in accordance with law.

In those circumstances, this Writ Petition is disposed of with the direction to respondent Nos.2 and 3 to complete the process of verification and take appropriate action in accordance with law and communicate the same to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
