HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.37319 of 2015 ORDER:

The petitioners stated that on the basis of a compromise, as recorded by the Hon'ble Supreme Court in I.A.No.1 of 2014 in S.L.P. (Civil) No.1107 of 2007 dated 19-11-2014, the petitioners made an application to the 4th respondent for mutation of their names in the revenue records in terms of the said decree. Since no action is taken, they stated to have made further representation to the 2nd respondent on 2303-2015 and as per the directions of the Joint Collector, Mahabubnagar, in Ref.No.D1/1666/2015, dated 20-06-2015, the petitioners representation was forwarded to the 4th respondent requiring him to verify the records and implement as per rules. The petitioners state that even as per the said directive, the 4th respondent has not taken any further action. Hence, the petitioners have approached this Court complaining of inaction.

Heard the learned Government Pleader for Revenue. In view of the directions already issued by the Joint Collector to the Tahsildar, as referred to above, the orders of the Civil Court, as modified by the Hon'ble Supreme Court in I.A.No.1 of 2014 in S.L.P. (Civil) No.1107 of 2007 dated 19-112014, on the basis of a compromise, the 4th respondent is duty bound to examine the matter in accordance with the records and the Rules and then pass appropriate orders with regard to the request of the petitioners for mutation. The writ petition is, therefore, disposed of directing the 4th respondent to act in terms of the aforesaid compromise and take appropriate action expeditiously, preferably within two months, if necessary, after conducting an appropriate enquiry. No order as to costs.
