THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CONTEMPT CASE No.659 of 2015 17.04.2015 Between:

G.Govindappa

...Petitioner

And The Revenue Divisional Officer, Kalyandurg, Anantapur District

...Respondent

Counsel for the petitioner: Mr.K.Narsi Reddy Counsel for respondent: Government Pleader for Civil Supplies (AP) The Court made the following:

ORDER:

This contempt case is filed alleging willful disobedience of the order, dated 28.11.2014, in W.P.No.36516 of 2014.

The grievance of the petitioner is that though this Court has given a categorical direction to the respondent to hold a detailed enquiry before passing any order adverse to the interests of the petitioner, the respondent has passed the order, dated 18.03.2015, without holding any enquiry and cancelling the petitioner's fair price shop authorization.

At the hearing, learned Government Pleader for Civil Supplies (Andhra Pradesh) submitted that on 08.04.2015, the respondent has withdrawn the aforementioned order and restored the petitioner's fair price shop authorization.

Though this Court is, prima facie, convinced that the respondent has committed a serious contempt by cancelling the petitioner's authorization without holding a detailed enquiry, having regard to the remedial measures taken by him by withdrawing the said order, I do not propose to proceed with the contempt case further. The respondent is, however, cautioned not to repeat such acts in future. The Contempt Case is accordingly closed.
