ORDER

Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the respondent-State. The petitioner was shown as accused in C.C.No.637 of 2011 on the allegation of committing the offences punishable under Sections 384, 323 & 506 read with 34 IPC.

Learned counsel for the petitioner would submit that absolutely there was no material against the petitioner-accused, but cognizance was taken against him erroneously. He further submits that as the petitioner is aged about 68 years, he seeks early disposal of C.C.No.637 of 2011.

Therefore, without going into the merits of the case, I direct the V Additional Judicial Magistrate of First Class, Nellore, to dispose of C.C.No.637 of 2011 within a period of four months from the date of receipt of a copy of this order.

With the above direction, the Criminal Petition is disposed of.
