THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6040 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondents 1 to 9 in affecting the petitioner's rights in spite of the orders of injunction granted by the learned Principal Junior Civil Judge, Palakol, in I.A.No.1139 of 2015 in O.S.No.213 of 2015. The said suit was filed by the petitioner herein against one N.Janardhan Rao. The suit is pending. As per the counter affidavit filed by the respondents, against the petitioner's son, crime No.213 of 2015 was registered on 26.12.2015 under Sections 447, 427, 506 IPC and a charge sheet was filed on 03.01.2016. The case is pending trial in C.C.No.52 of 2016 before the Judicial First Class Magistrate, Palakol. The police stated that they never interfered with the civil dispute except registering the above case basing on the complaint of one N.Janardhan Rao. The specific allegation against the fourth respondent in calling the petitioner and his son to the police station and slapping his son on 17.01.2017 and detaining them from 10.00 a.m., to 09.00 p.m., is also denied.

In view of the same, no further orders are necessary in the present writ petition. However, if the police/fourth respondent is interfering, it is open to the petitioner to bring the high-handed action of the fourth respondent, if any, to the notice of the second respondent. The writ petition is accordingly closed. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 20.04.2017 pln
