HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner is presently working as Senior Assistant. He claims that he is now eligible to be promoted as Naib Tahsildar. Though petitioner was initially belonging to Ranga Reddy District unit, after formation of new districts he was allotted to MedchalMalkajgiri district, and this district became his Unit of appointment. On 16.03.2016, charge-memo was issued to the petitioner. It appears, Enquiry Officer was appointed to enquire into the charges levelled against the petitioner. However, there was not much of a progress for long time. In the mean time, petitioner was allotted to Medchal-Malkajgiri district.

On 06.06.2019, the District Collector, Medchal-Malkajgiri appointed the District Minorities Welfare Officer as Enquiry Officer and the Tahsildar, Quthubullapur, as Presenting Officer with a direction to complete the enquiry by 30.09.2019.

In the written instructions furnished to the learned Assistant Government Pleader, it is also stated that as of now there are no vacancies of Naib Tahsildars in Medchal-Malkajgiri district, and as and when vacancies arise, petitioner would be considered as per the procedure.

Learned counsel for petitioner as well as learned Government Pleader agree for disposal of the Writ Petition with a request to fix time limit for completing the enquiry.

Having regard to the fact that charge-memo was dated 16.03.2016 and so far there is no further progress, the District

Collector, Medhcal-Malkajgiri is directed to finalize the disciplinary proceedings within a period of three months from the date of receipt of copy of this order. If for any reason not attributable to the petitioner disciplinary proceedings cannot be completed, he may be considered strictly in accordance with G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999 for promotion if he is otherwise eligible and qualified in the vacancies that arise in future. It is made clear that petitioner shall co-operate in the enquiry. As Court grants more time, it is expected that the District Collector (2nd respondent) shall ensure that the proceedings are concluded within the time granted. 5.

Writ Petition is accordingly disposed of.

Pending miscellaneous petitions shall stand closed.
