THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7173 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner - accused No.1 in Crime No.368 of 2023 pending on the file of Station House Officer, AJ Mills Colony Police Station, Warangal District, filed for the offence punishable under Section 498-A of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that de facto complainant filed a complaint on 13.06.2023 stating that eleven years prior to the death of his daughter, she was married to this petitioner and they had two children. This petitioner was addicted to alcohol and he was not doing any job and he harassed the deceased to get more money. The mother of this petitioner who is arrayed as accused No.2 abetted the petitioner in harassing the deceased. Though the

de facto complainant requested the petitioner not to harass his daughter, the harassment continued. Unable to bear such harassment, the wife of the petitioner committed suicide on 12.06.2023.

On instructions, learned Additional Public Prosecutor would submit that witnesses were examined and major part of investigation is complete.

As seen from the remand report, the petitioner was remanded to judicial custody on 04.07.2023. Since major part of the investigation is complete, the petitioner can be granted the relief of regular bail subject to conditions.

Accordingly, the Criminal Petition is allowed and the petitioner-accused No.1 is granted bail subject to the following conditions:

i) The petitioner - accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of learned I Additional Judicial First Class Magistrate, Warangal.

ii) The petitioner - accused No.1 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks from the date of this order or till filing of charge sheet, whichever is earlier. iii) The petitioner - accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
