THE HONOURABLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.8187 OF 2017 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed seeking to quash the proceedings in C.C.No.222 of 2015 on the file of the I Additional Junior Civil Judge, Eluru, for the offences punishable under Sections 464, 465, 467, 468, 471, 406 and 506 (2) read with 34 of Indian Penal Code. Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor.

Though various grounds are raised in the Criminal Petition, the learned counsel for the petitioners restricts his prayer seeking dispensation of presence of the second petitioner before the trial Court and also liberty to file an application before the trial Court seeking discharge.

The same is not seriously disputed by the learned APP. Having regard to the above, the Criminal Petition is disposed of granting liberty to the petitioners to file an appropriate application before the trial Court seeking discharge. Further, since the question of identity of the accused does not arise, the presence of the second petitioner above, before the trial Court, is dispensed with, except on the dates when her presence is required by the trial Court. The second petitioner shall not complain of any orders being passed by the trial Court in her absence, as she is duly represented by the first petitioner-A.1 and also by the counsel.
