HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.4959 of 2015 ORDER :

This civil revision petition is filed under Article 227 of the Constitution of India, by the defendants in the suit in O.S.No.408 of 2009 on the file of XII-Additional Chief Judge, City Civil Court, Hyderabad, aggrieved by order, dated 13.03.2014, passed in I.A.No.20 of 2014.

The suit in O.S.No.408 of 2009 is filed by the respondent/plaintiffs for eviction of petitioners herein and when the matter was coming up for further cross-examination of PW-1, the request made by the counsel for petitioners for adjournment, was rejected and evidence of PW-1 was closed. Heard learned counsel for the parties.

Even the learned counsel for respondents express no objection to allow this revision with a direction to the trial Court to dispose of the suit itself. As much as the suit is for eviction, this Court is of the view that further opportunity can be given to the petitioners herein to cross-examine PW-1. In view of the submission made by the learned counsel for the parties, this civil revision petition is allowed and the order, dated 13.03.2014, is set aside. The petitioners are permitted to cross-examine PW-1 on the next date of hearing. At the same time, as the suit is of 2009, the learned XII-Additional Chief Judge, City Civil Court, Hyderabad, is directed to dispose of the suit as expeditiously as possible, preferably within a period of six months from today. No order as to costs.
