THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CIVIL REVISION PETITION No.1542 of 2016 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed seeking a direction to the Family Court, Visakhapatnam to decide I.A.No.462 of 2015 in G.O.P. No.927 of 2015 forthwith. Sri V. Surendra Reddy, learned counsel for the petitioner, would submit that the petitioner's children aged about 12 and 8 years have been removed from the School where they were studying at Visakhapatnam; the respondent has admitted them in a small school in Mopidevi; and, in the fight between husband and wife, the children's education should not suffer. He would further submit that the respondent is seeking to have the matter adjourned beyond Summer Vacation, and thereby prevent the children from being admitted in a good School in Visakhapatnam.

While it may not, ordinarily, be appropriate for this Court, while exercising jurisdiction under Article 227 of the Constitution of India, to fix a time schedule within which a particular matter should be disposed of, I have no reason to doubt that on a request being made before the Court below, similar to the one being made before this Court, the Court below would consider such a request for an early hearing. The Civil Revision Petition is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
