THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.828 of 2000 JUDGMENT:

This appeal is filed under section 100 CPC assailing the judgment and decree dated 27.07.2000 in A.S.No.394 of 2000 (old A.S.No.332 of 1996 on the file of III Additional District Court, Visakhapatnam) on the file of I Additional Senior Civil Judge Court, Visakhapatnam, wherein whereby the decree and judgment dated 30.09.1996 in O.S.No.717 of 1990 on the file of Principal District Munsif Court, Visakhapatnam, dismissing the suit filed by the plaintiff for declaration and delivery of possession, was reversed. 2.

None appeared on behalf of the appellant. This Court issued a notice to the appellant. The notice also returned as unserved with an endorsement as 'insufficient address'. It seems that the appellant is not interested to prosecute the matter.

Hence, the appeal is dismissed for non-prosecution. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
