THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.1849 of 2012 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondent, in not issuing the tender schedules free of cost to the petitioners and in not indicating that payment of EMD was exempted to individuals and the Scheduled Castes and Scheduled Tribes labour contract societies in its tender notification dated 12.1.2012, as arbitrary and illegal. A consequential direction is sought to the respondent to follow the Circular memo dated 14.10.2002, to exempt Earnest Money Deposit to the petitioners as per GO Ms. No. 52 dated 18.3.2000, and to issue tender schedules free of cost.

By way of an interim order, passed in W.P.M.P. No. 2296 of 2012 dated 27.1.2012, this Court directed the respondent to supply tender schedules free of cost, if the petitioners applied for the same; and to consider their tenders without insisting on payment of Earnest Money Deposit.

In the light of the said interim order, the petitioners must have been issued tender schedules free of cost, and their tenders would have been considered without insisting on the Earnest Money Deposit.

As the subject tender relates to the tender notification dated 12.1.2012, which was issued more than six years ago, the tender must have been awarded, and the work completed by now. The cause in the Writ petition no longer survives necessitating any further adjudication by this Court. The Writ Petition has become infructuous and is, accordingly, dismissed. Miscellaneous

petitions, pending, if any, shall also stand dismissed. There shall be no order as to costs.
