FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE FIFTH DAY OF FEBRUARY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.836 of 2015 BETWEEN D.Rajagopal Reddy and another ... PETITIONERS AND The State of Andhra Pradesh, Rep. by its Principal Secretary (Department of Home), Secretariat Building, Hyderabad and others. ...RESPONDENTS The Court made the following:

ORDER:

Heard.

2. The grievance of the petitioners in this writ petition is that in spite of filing of complaints, dated 05.01.2015 and 03.01.2015 respectively, through registered post, the respondents, particularly respondent Nos.3 and 4, have neither registered any crime nor taken up any action.

3. Instructions of the learned Government Pleader, however, show that the complaint of petitioner No.1 dated 03.01.2015 was received by respondent No.1 through post and thereafter, the complaint of petitioner No.2 dated 05.01.2015 was received through post. Petitioner alleged in the said

complaint that respondent Nos.5 and 6 and others trespassed into the land to an extent of Ac.21-00 cents in Survey Nos.461, 524, 525 and 527 in violations of the injunction orders granted by the III Additional Junior Civil Judge, Nellore in O.S.No.267 of 2011. It is stated in the instructions that based on the said Complaint, a case in Crime No.16 of 2015 was registered on 29.01.2015 against respondent No.6 before respondent No.4 police station and investigation is taken up. It is also stated that the investigating officer has visited the scene of offence and examined the petitioners and others and recorded their detailed statements.

4. In view of that, since the Crime is already registered and investigation is already under progress, no further orders are required to be passed except directing respondent No.4 to complete the investigation expeditiously and file appropriate charge sheet/final report before the jurisdictional court. With the above direction, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
