THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7174 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner - accused No.1 in Crime No.136 of 2023 pending on the file of Station House Officer, Langerhouse Police Station, Hyderabad, filed for the offence punishable under Section 306 of the Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that petitioner developed illegal relationship with another woman and used to harass the deceased who is his wife. When questioned about his adulterous affair, the petitioner allegedly scolded and beat deceased. For the said reason, the deceased committed suicide on 16.04.2023, by hanging herself to the ceiling fan.

The petitioner was remanded to judicial custody on 19.06.2023. As seen from the remand report, witnesses were examined and major part of investigation is complete and the same is not disputed by the learned Additional Public Prosecutor. In the said circumstances, the petitioner can be granted the relief of regular bail subject to conditions.

Accordingly, the Criminal Petition is allowed and the petitioner-accused No.1 is granted bail subject to the following conditions:

i) The petitioner - accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of learned VI Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. ii) The petitioner - accused No.1 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks from the date of this order or till filing of charge sheet, whichever is earlier.

iii) The petitioner - accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 09.08.2023 rev
