THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No.703 OF 2016 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, to issue a direction against respondent No.4 to pass appropriate order in accordance with law on the petition filed by the petitioner in the Month of August, 2011 under the provisions of Andhra Pradesh (Telangana Area) Tenancy and Agricultural Lands Act, 1950 (for short 'the Act') and to restore their possession in regard to land admeasuring Ac.4.30 gts., in Sy.No.349 situated at Varshakonda Village of Ibrahimpatnam Mandal of Karimnagar District.

The main contention of the counsel for the petitioners is that the petitioners are occupiers of the property, they are entitled to claim occupancy certificate under Section 38 of the Act. The officer concerned did not pass any order on the petition filed by the petitioners, though it is pending since long time. The learned Government Pleader for Revenue (T.S.) reported no objection to issue a direction to respondent No.4 to pass appropriate order and dispose of the petition filed by the petitioners, in accordance with law.

In view of the submission of the learned Government Pleader for Revenue (T.S.) and considering the long pendency of the petition, the 4th respondent is directed to dispose of the petition

WP_703_2016 MSM, J - 2 - filed by the petitioners, in accordance with law, within three months from the date of receipt of a copy of this Order. With the above direction, the writ petition is disposed of. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
