HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20145 of 2019 ORDER:

The prayer of the petitioners in this Writ Petition is as under: "...to issue any appropriate writ order or direction particularly one in the nature of writ of mandamus declaring the inaction of the respondent police in registering the report of the petitioner dated dt 30.7.2019, 31.7.2019, 26.08.2019, 07.09.2019 and 08. 09.2019 as arbitrary illegal and in violation of Articles 14 and 21 of the Constitution of India and consequently direct the 2nd respondent to take disciplinary action on the 4th and 5th respondents and be pleased to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home produced the written instructions, dated 16.9.2019, wherein it is inter alia stated that basing on the complaint of the petitioners, a petty case in Crime No.1197 of 2019 on the file of Gandhinagar Police Station is registered under Section 70 (B) IPC and that on enquiry, it was disclosed that the matter pertains to land issue and civil case is pending between parties and as such both the parties were informed to approach the competent civil Court.

In view of the above, the grievance of the petitioners stood redressed.

The Writ Petition is accordingly disposed of As a sequel, Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
