THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25749 of 2017 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Roads and Buildings for respondent Nos.1 and 2 and Sri N. Praveen Kumar, learned Standing counsel for respondent No.3.
Petitioner claims to be the owner of the residential plot bearing S.No.993 admeasuring 311.11 square feet situated at Ward No.3, Block 7, Ravindra Nagar Colony, Sadasivapeta, Sanga Reddy District having purchased the same under registered sale deed. The complaint of the petitioner in the present writ petition is that the respondents are trying to encroach upon her private property to an extent of 40 square yards for the purpose of road widening without following due process of law.
On the other hand, it is submitted by the learned Government Pleader for Roads and Buildings and the learned Standing counsel that the allegations made by the petitioner are false and that if the private property of the petitioner is really required, the respondent authorities will adhere to the due process of law and proper steps will be taken in accordance with law.
In view of the above submission made by the learned Government Pleader so also the learned Standing counsel for the respondents, the writ petition is disposed of directing the
respondents not to meddle with the private property of the petitioner, without recourse to law. It is made clear that it is open for the respondents to proceed in accordance with law, if the private property of the petitioner is required. No order as to costs.
Miscellaneous petitions, if any, shall also stand disposed of.
