THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7249 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused seeking anticipatory bail in the event of his arrest in connection with Crime.No.81 of 2023 on the file of Madgul Police Station, Ranga Reddy District, registered for the offences punishable under Sections 420, 467, 468 and 471 r/w. 34 of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Learned counsel for the petitioner would submit that the name of this petitioner was not mentioned in the complaint dated 16.06.2023 which was given to the Inspector of Police, Madgul Police Station. The crime was registered on the basis of the complaint which mentions regarding sale transactions. In the said sale transactions, a fake agreement of sale dated 28.12.2022 was created. He further submit that this Court by order dated 07.07.2023 in Crl.P.No.5832 of 2023 granted relief of anticipatory bail to the accused/A-2 and A-3.

Learned Additional Public Prosecutor would submit that the name of the petitioner was stated by A-1 during the course of his confession.

Keeping in view that the only evidence against this petitioner is an alleged confession of A-1, this Court is of the opinion that this petitioner can be granted relief of anticipatory bail, subject to the following conditions:

1) The petitioner/Accused shall be enlarged on bail, on his executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of the concerned Station House Officer.

2) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
