HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 22842 of 2016 Order:

The petitioner's father worked as an Attender in the second respondent-Bank. His services were continued beyond 58 years by virtue of the interim orders passed by this Court in WP No.17895 of 2014. However, while in service, he died. The petitioner submitted a representation to the second respondent-Bank requesting to appoint him on compassionate grounds and his mother also personally approached the second respondent-Bank. The Special Commissioner for Cooperation and Registrar of Co-operative Societies, Hyderabad, also addressed a letter on 04.11.2015 to the second respondent for taking necessary action on the representation submitted by the petitioner on 06.10.2015.

A communication was sent to the Commissioner for Cooperation and Registrar of Cooperative Societies, Hyderabad, by the second respondent on 19.11.2015 stating that the Bank has not accepted the continuation of the petitioner's father after his retirement and hence the request of the petitioner for compassionate appointment could not be considered.

2. However, it is clear that there was an interim order directing continuance of the petitioner's father and the petitioner's father was continued beyond the age of retirement. Whether he is entitled for continuance beyond the age of 58 years or not is a subject matter in the Writ Petition No.17895 of 2014. There is no dispute that the petitioner's father died while in service.

3. This Court ordered notice before admission and in spite of service of notice on the second respondent, the second respondent did not choose to appear before this Court.

4. In the circumstances, this Writ Petition is disposed of directing

the second respondent to consider the case of the petitioner for appointment on compassionate grounds pursuant to the representation of the petitioner's mother and also that of the petitioner according to the scheme applicable to the compassionate appointments in the Bank and pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
