THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17353 of 2017 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the respondents particularly the 4th respondent in entertaining to establish (within 300 mtrs) A4 shop near to the premises bearing No.8/7-D-1, of Rajampet Municipality, Y.S.R District, as arbitrary and illegal and against the A.P. Excise Rules, 2012, and consequently direct the 4th respondent not to entertain the others A4 shop till the licence period (01.07.2015 to 30.06.2017) of the petitioner which was granted vide License No.81/2015-17 (License period from 01.07.2015 to 30.06.2017) of Rajampet Municipality, Y.S.R District.

Heard and perused the material available on record. 3.

When the matter is taken up for consideration, learned Government Pleader for Excise appearing for the respondents informed that the respondents have not intend to establish any new shop till 30.06.2017.
