HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.17016 of 2014 in Crl.P.No.15897 of 2014 and Criminal Petition No.15897 of 2014 COMMON ORDER:

Defacto complainants and their counsel Sri P.Ravindra are present. Accused and their counsel Sri Siva S.Lanka are present.

On the report given by defacto complainants the police of Jaggaiahpet PS registered Cr.No.237 of 2014 for the offences under Sections 419, 420, 471 and 34 IPC with the allegation that the paternal uncle and other relations of the accused conspired to grab away the property of defacto complainants' family and they are creating forged documents. The investigation is reported to be pending.

At this stage, both parties and their counsel present in the Court and submitted that at the intervention of elders they have amicably settled their disputes and living peacefully and there is no threat for the complaints from the accused and hence complainants have no objection for quashment of proceedings in Cr.No.237 of 2014 and therefore, they may be permitted to compound the offence and proceedings may be quashed accordingly in the interest of justice.

Having regard to the above submission and considering the fact that it is a property dispute between the family members which they have amicably settled at the intervention of elders and

there is no threat for the complaints from the accused and no useful purpose will be served if the investigation is ordered to be continued and following the decision reported in Gian Singh v. State of Punjab and another[1]this petition is allowed and permission is accorded to the parties to compound the offence and compromise is recorded and proceedings in Cr.No.237 of 2014 of Jaggaiahpet PS are hereby quashed.

In view of the quashment of proceedings, the trial Court is directed to verify the remand report submitted by the police and if any cash is recovered by the police from the accused as per the remand report, the trial Court shall order for repayment of those amounts to the concerned accused.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
