HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 5877 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of look out circular/ notice issued against the petitioner by the 3rd respondent-Deputy Commissioner of Police, Cyberabad in Crime No.467 of 2015 of Kushaiguda Police Station, Cyberabad. 2.
It has been submitted on behalf of the petitioner that the petitioner is arrayed as accused No.4 in Crime No.467 of 2015 of Kushaiguda Police Station, Cyberabad, which was registered for the offences punishable under Sections 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act. The police filed charge sheet which was taken cognizance as C.C.No.1200 of 2015 against accused Nos.1 to 3. In the said charge sheet, it was mentioned that separate charge sheet will be filed against the petitioner/ A.4 as she is residing in U.S.A. It is also submitted that the Court issued Non Bailable Warrant against the petitioner and the Deputy Commissioner of Police, Cyberabad, also issued Look Out Circular against the petitioner. It is also submitted that vide judgment, dated 13.03.2019, accused Nos.
1 to 3 were acquitted and neither the de facto complainant not the State preferred any appeal against the acquittal judgment, dated 13.03.2019 passed in C.C.No.1200 of 2015. It is also submitted that the Non Bailable Warrants issued against the petitioner were recalled by the XIX Additional Metropolitan Magistrate, Cyberabad at Malkajgiri, vide order dated 22.08.2019.

Learned Additional Public Prosecutor submits that this Court granted stay of all further proceedings against the petitioner in Crime No.467 of 2015.

A perusal of the material on record would show that the Non Bailable Warrants issued against the petitioner have already been recalled by the Court concerned and accused Nos.1 to 3 in the above crime have been acquitted by the trial Court vide judgment dated 13.03.2019 in C.C.No.1200 of 2015. Moreover, by an order, dated 24.09.2019 in Criminal petition No.6016 of 2019, this Court granted stay of all further proceedings against the petitioner in Crime No.467 of 2015. Having regard to the facts and circumstances of the case, Look Out Circular/ Notice issued by the 3rd respondent-Deputy Commissioner of Police, Cyberabad, is liable to be withdrawn. 5.
In the result, the Criminal Petition is allowed and the third respondent is directed to withdraw the Look Out Circular/ Notice issued against the petitioner/ accused in Crime No.467 of 2015 of Kushaiguda Police Station, forthwith.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
