THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17300 OF 2016 ORDER:
This writ petition is filed challenging seizure of goods vide panchanama dated 28.04.2016 drawn by the 3rd and 4th respondents.
Heard the learned counsel for the petitioner as well as the learned Government Pleader.
Though the learned counsel for the petitioner raised various grounds in the writ petition, at the time of hearing he confined his arguments only to the extent of issuance of a direction to the second respondent to complete enquiry and pass orders on merits after considering the explanation to be submitted by the petitioner. Learned counsel for the petitioner further undertakes that the petitioner would submit his explanation within a period of two weeks from the date of receipt of show cause notice.
Hence, the second respondent is directed to issue a fresh show cause notice to the petitioner within a period of one week from today Inasmuch as the seizure of the goods has been effected only on the ground that there is variation in the stock register with the ground balance, in the interest of justice, there shall be stay of conducting auction till disposal of the proceedings by the 2nd respondent. As the goods seized are palm oil and food grains, the second respondent shall complete the entire exercise within a period of eight weeks from the date of receipt Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
