HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL REVISION PETITION No.971 OF 2003 ORDER:

This revision is preferred questioning the order dated 5-11-2002 in E.P.No.33 of 1999 in O.S.No.3228 of 1985 whereunder lower court dismissed execution petition.

This revision has come up for hearing on 17-2-2016. As there was no representation, it was directed to be posted under the caption of dismissal and accordingly, it was adjourned to 23-2-2016 under the caption of dismissal. On that day, advocate for respondents sought time and it was again adjourned to 29-2-2016 under the same caption and on 29-2-2016, at the request of advocate for petitioners, the dismissal caption was deleted and adjourned by two weeks and the matter was listed on 16-3-2016. Again advocate for petitioners sought time by two weeks and the same is granted and the case was again listed on 4-4-2016. On that day also, again advocate for petitioners sought time and court accommodated and adjourned the case again.

When the matter is listed to today, again adjournment is sought on the ground that bundle is misplaced.

I am not convinced with the reason for adjournment and as the petitioners are taking time and not showing any interest in prosecuting the case, I am of the view that revision has to be dismissed for non-prosecution. Accordingly, this Civil Revision Petition is dismissed for non-prosecution. No costs. As a sequel to the disposal of this revision, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
