THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.35235 of 2016 ORDER:
The petitioner complains against inaction in disposing of representation dated 10-10-2016 in the light of 3rd respondent's report dated 28-09-2015.
I have perused the representation, dated 10-10-2016. This Court prima facie is of the view that the report of 3rd respondent is dated 28-09-2015, the 2nd respondent ought to have taken a decision on the said report within a reasonable time. Since no decision is taken, as stated in the affidavit, I am satisfied the writ petition can be disposed of by this order without going into the merits of the writ petition.
The 2nd respondent considers and disposes of representation dated 10-10-2016, keeping in view the report dated 28-09-2015, within eight weeks from the date of receipt of a copy of this order. It is needless to observe that respondents 4 to 6 are also heard in the enquiry if the 2nd respondent proposes to conduct in this behalf and pass appropriate orders.
